Conservation Commission advances tougher tree-replacement rules for Wayland

WAYLAND — March 5, 2025 — Wayland Conservation Commission advances stricter tree-replacement rules and approves two lakeside septic projects. Vice-Chair Shannon Fischer presented draft Chapter 193 revisions modeled on neighboring towns moving toward "one-to-one inch replacement" of diameter at breast height, with a permit triggered by removing six trees or 19 inches DBH. Commissioners agreed to authorize third-party arborist peer reviews at applicant expense and to build in a rebuttable presumption that trees cut without a permit were healthy, with up to double replacement for after-the-fact violations. Administrator Linda Hansen stripped out illicit-discharge language inserted by a DPW consultant, saying "this bylaw is for private home, private construction." The commission unanimously approved septic replacements at 31 White Road and 38 Lakeshore Drive — the latter including a voluntary $10,000 Singulair nitrogen-reducing upgrade beside Dudley Pond — and declined to close out 90 Dudley Road after a deck was found rebuilt into the 15-foot no-disturb buffer.
