Wayland Conservation Commission issues enforcement order for unpermitted wetlands excavation

WAYLAND — November 9, 2022 — Wayland Conservation Commission ratifies enforcement order over unpermitted wetlands work at 28 Marshall Terrace. Conservation Administrator Linda Hansen told the board she found a newly built sports court within five feet of a stream, a large excavated hole and a hired excavator operating inside the wetland after neighbors flagged the work; she bypassed a violation notice and went "straight to an enforcement order." The 6-0 vote came in a marathon Nov. 9 meeting that also continued a notice of intent from Dr. Miguel Ortiz to rebuild a three-story dental office at 233 Boston Post Road — where five proposed employee parking spaces sit inside the 30-foot no-disturbance buffer — and continued a 3,150-square-foot single-family rebuild at 135 Old Connecticut Path for owner Ulysses Hernandez. Chair Sean Fair pressed for the excavation contractor's name, calling the contractor responsible for "a big share of the fault." The board also accepted the deed for 27 Sherman Bridge Road ahead of a Nov. 22 closing.
